What is Criminal Law?

A criminal case is any case tried in either Circuit or General District court. Those court cases involve a defendant and the defense team, a Commonwealth’s Attorney, a judge, and possibly (a) jury. A criminal case is started after a crime is committed, causing the Commonwealth to bring charges against the defendant. In some cases, the defendant may be arrested. A criminal case usually includes several court appearances and, in some cases, a plea deal negotiation. The case ends with either a conviction and sentence (or, punishment) if the defendant is found guilty or an acquittal if the defendant is found not guilty. If procedural issues arise, the case or the charges themselves may also be dismissed.

There are two types of criminal offenses: Misdemeanors and Felonies.

Misdemeanors

A class one misdemeanor carries a penalty of up to 12 months in jail and up to a $2500 fine. Examples of common misdemeanors are:

  • Trespassing
  • Disorderly Conduct
  • Indecent Exposure
  • Petit Larceny

Felonies

On the other hand, felonies include more serious offenses. They carry a range of prison time of a year or more up to life imprisonment. Some examples of felonies are:

  • Murder
  • Malicious Wounding
  • Kidnapping
  • Manslaughter or Rape
  • Fraud Offenses
  • Burglary
  • Possession of a Schedule I or II substance
  • Arson

Miranda Rights:

This is given to someone during arrest as a spoken “Miranda warning.” Miranda Rights are used by law enforcement to make the detained party aware of certain rights

Plea Agreement:

This is an arrangement between a Commonwealth’s Attorney and the defendant. This is when the defendant enters a plea in exchange for something, and this is often for some sort of leniency.

Arraignment:

This is a court proceeding at which a criminal defendant is formally advised of the charges against them.

Discovery:

The disclosure of documents relevant to the case by the Commonwealth’s attorney and the defense team is called discovery.

Capital Offense:

A capital offense is a crime that is punishable by the death penalty.
